Welcome to WAU! The terms "we", "us" and "our" refer to WAU. WAU operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). WAU is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use or access our Services.

SECTION 1 - ACCESS, ACCOUNT SECURITY, AND ANTI-FRAUD

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To purchase any products, you must provide correct, current, and complete information, including your email address, billing, and shipping details.

You are solely responsible for maintaining the security of your account credentials. You may not transfer or assign your account to any other person. WAU reserves the right, in its sole discretion, to monitor accounts for signs of fraud, duplication, or system exploitation. If we detect multiple accounts or distinct registered email addresses created by the same individual to exploit promotional codes, store credits, or discounts, WAU reserves the absolute right to consolidate accounts, cancel pending orders, or revoke store credits to maintain community fairness.

SECTION 2 - OUR PRODUCTS AND TECHNICAL ENGINEERING

We make every effort to display the accurate colors, textures, and engineered specifications of our apparel. However, actual product appearance may differ due to your device’s display configurations.

WAU products, particularly our specialized technical gear, are designed for specific performance metrics. We do not warrant that the final fit, textile feel, or performance output of any products will perfectly match your subjective expectations. All product descriptions, material specifications (such as TechSilk or other technical fabrics), and sizing charts are subject to change at any time without notice at our sole discretion. We reserve the right to limit quantities or discontinue any product at any time.

SECTION 3 - ORDERS AND RIGHT OF REFUSAL

When you place an order on our platform, you are making an offer to purchase. WAU reserves the absolute right to accept, decline, limit, or cancel your order for any reason at our sole discretion, even after a confirmation email or payment processing.

Reasons for order modification or cancellation include, but are not limited to:

Stock inaccuracies or sudden inventory shortages.
Discrepancies in pricing, typographical errors, or description omissions.
Suspicion of unauthorized commercial resale, bulk buying, or export.
System glitches or promotional exploitation.

If we cancel or modify your order, we will notify you via the email or phone number provided. Approved purchases are subject to return or exchange strictly in accordance with our Return & Refund Policy.

SECTION 4 - PRICING, PROMOTIONS, AND STORE CREDIT

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the exact millisecond the order is placed. Posted prices do not include taxes, shipping, handling, or customs charges unless expressly stated.

Any store credit, promotional codes, or vouchers issued by WAU are governed by separate specific terms. Unless explicitly stated otherwise by WAU, store credits assigned to a verified account have no expiration date and remain valid indefinitely. To redeem any store credit or early-subscriber benefits, you must be securely signed into your registered email account prior to checkout. Store credits cannot be transferred, exchanged for physical cash, or applied retroactively after an order has been finalized.

SECTION 5 - SHIPPING, LOGISTICS, AND TRANSFER OF RISK

All delivery timelines provided on the website or during checkout are non-binding estimates only. WAU is not liable for shipping delays, customs hold-ups, carrier disruptions, or regional delivery failures.

Once WAU transfers the physical products to the third-party shipping carrier, the title of the goods and the entire risk of loss or damage passes completely to you (the customer). Any claims regarding lost, stolen, or damaged packages during transit must be filed directly by the customer with the respective shipping carrier.

SECTION 6 - INTELLECTUAL PROPERTY AND BRAND PROTECTION

Our Services, including but not limited to the WAU name, Waucult systems, logos, product names, text, graphics, designs, video, audio, slogans (including "The battle is mental, sky is the limit, conquer your chaos."), and visual layouts, are the exclusive intellectual property of WAU, its affiliates, or its licensors.

These Terms permit you to use the website for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, or commercially exploit any material without our prior written consent. Unauthorized use of WAU’s intellectual property will result in immediate termination of access and may subject the violator to civil and criminal legal action under applicable laws.

SECTION 7 - PROHIBITED USES AND AUTOMATED AGENTS

You may use the Services for lawful purposes only. In addition to general restrictions, you are strictly prohibited from using any automated systems, scrapers, data-mining devices, software robots, or artificial intelligence (including agentic AI or autonomous scraping tools) to monitor, extract, buy out stock, or interact with our platform.

Any automated Agent attempting to access the platform must strictly identify itself in the HTTP/HTTPS request strings (as "Agent/[agent name]") and must not mimic human behavior or attempt to circumvent CAPTCHAs. WAU reserves the right to employ advanced firewall and blocking mechanisms and may suspend or terminate any user account or IP access immediately without notice upon detecting prohibited automation or scraping activities.

SECTION 8 - LIMITATION OF LIABILITY AND WARRANTY DISCLAIMER

THE SERVICES AND ALL PRODUCTS DELIVERED TO YOU THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT SHALL WAU, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND. THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, REVENUE, SAVINGS, OR DATA, SYSTEM DOWNTIME, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.

SECTION 9 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless WAU, Shopify, and our partners, officers, directors, employees, and agents from any third-party claims, liabilities, losses, damages, or costs (including reasonable attorneys' fees) arising out of or relating to:

Your breach of these Terms of Service.
Your violation of any applicable local or international laws.
Your unauthorized interaction with or misuse of the Services.

SECTION 10 - GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, construed, and enforced exclusively in accordance with the laws of the Republic of Indonesia.

Any legal actions, disputes, or proceedings arising out of or relating to these Terms or the purchase of WAU products shall be brought exclusively before the courts located in Jakarta Selatan, Jakarta, Indonesia, and you hereby expressly consent to the personal jurisdiction and venue of such courts.
